Dans le présent texte, l’auteur présente le cœur de son argumentation qui a servi d’avis au Procureur général du Canada dans le contexte des procédures judiciaires intentées par Marc Lefrançois, ex-président de Via Rail (société nationale de transport ferroviaire canadien), contre le Procureur général du Canada pour dommages moraux et dommages exemplaires, en raison de son congédiement, motivé par le non respect de ses engagements à l’égard de l’éthique. L’auteur a structuré son argumentaire afin de répondre aux questions suivantes : quelle est l'importance et quel rôle joue l'éthique dans le lien de confiance d'un gouvernement ou du public à l'égard du titulaire de charge publique ? Quel type de normativité éthique régit la conduite d'une personne titulaire d'une charge publique ? Ces balises sont-elles différentes de celles du milieu privé et, le cas échéant, quelles sont ces différences ? Dans le cadre de ce mandat, l’auteur a tenté de répondre aux questions posées à partir de sa posture de politologue spécialisé en éthique appliquée au contexte gouvernemental ; il a alors analysé les dispositifs officiels qui ont été mis en place par nos gouvernements au cours des dernières années et aux différents rapports faits par des agents publics, que l’on nomme souvent les gardiens de l’éthique gouvernementale.
