Abstract
L’objectif de cet article est d’établir un rapport de filiation entre les idées de John R. Commons et certaines propositions formulées en économie du développement. Il est, en effet, possible de constater que les idées de Commons présentent des analogies avec celles d’Hernando de Soto. A partir du rôle fondamental qu’ils assignent à l’institution de la propriété, les deux hommes mettent l’accent sur la place des aspects juridiques dans leur compréhension du système capitaliste. Leur analyse de la fonction politique fournit un éclairage supplémentaire à l’originalité de leur perspective tout en les exposant à de sévères critiques. De Soto est même parfois accusé de se trouver en phase avec le néolibéralisme. Pour ce qui est de Commons, il ne doit pas être rattaché à cette idéologie. Une comparaison avec North et Greif permet cette fois de faire ressortir la spécificité de son point de vue théorique que ce soit en termes de justice sociale ou d’efficience.
