Abstract
Depuis trente ans, le Québec connaît une législation innovante en matière de droit de la famille. La première partie de cet article retrace l’évolution de cette législation selon une approche chronologique ; elle met en lumière certains indices suggérant que le législateur, en fournissant des réponses ponctuelles à des demandes légitimes, fait émerger diverses catégories de citoyens. Cette émergence est aussi confortée par la confusion existant entre “filiation” et “parentalité”. Dans une deuxième partie sont examinées deux positions contenues dans un avis de la Commission de l’éthique de la science et de la technologie, qui, si elles sont susceptibles d’éclairer partiellement quelques spécificités québécoises, corrigent malaisément des asymétries entre des catégories.
