Abstract
Consumer dispute resolution mechanisms are facing rapidly evolving legal change in Canadian jurisdictions. With the rise in pre-dispute mandatory arbitration clauses in standard form consumer contracts, courts and legislators have intervened to determine the interaction between judicial policies embodied in class action and arbitration regimes, as these apply in the consumer field. The article examines recent case law and legislation that has given priority to class actions over arbitration in consumer disputes and considers the impact of the diversity of approaches in the various provinces, including the transborder issues involved.
