Résumé La troisième voie compte aujourd’hui parmi les dispositifs contribuant à l’effectivité des orientations de politique gouvernementale française en faveur d’une réponse pénale systématique. En attestent les deux indicateurs de performance retenus par la Chancellerie pour rendre compte de l’amplification et de la diversification de la réponse pénale : le taux de réponse pénale et le taux d’alternatives aux poursuites. À partir des résultats d’une enquête qualitative et quantitative réalisée dans les juridictions françaises de Bobigny et de Bordeaux, cet article propose d’apporter un éclairage sur les modalités d’utilisation de ce mode de traitement pénal et sur les variations auxquelles il donne lieu au gré des contextes locaux. Ce faisant, il interroge la pertinence des indicateurs utilisés actuellement pour mesurer la performance des juridictions dans la réalisation des deux objectifs précités.
