Il saggio prende lo spunto dalla decisione assunta dalla Corte del lavoro svedese nel seguito nazionale di per interrogarsi sugli effetti che la giurisprudenza comunitaria potrebbe determinare sulla disciplina italiana dei rimedi disponibili in caso di sciopero illegittimo. Dopo aver evidenziato che la disciplina nazionale in materia č essenzialmente rivolta a regolamentare lo sciopero effettuato nell'ambito dei servizi pubblici essenziali, si sostiene che la peculiare natura dei rimedi previsti in caso di illegittimitŕ dei suddetti scioperi, ne impedisce l'applicabilitŕ alla ipotesi dello sciopero comunitariamente illecito. Il saggio si sofferma quindi sulla residualitŕ tradizionalmente propria del rimedio risarcitorio nell'ordinamento nazionale, cercando di individuarne le ragioni, per passare poi ad indicare il rimedio in grado di garantire in ambito nazionale il principio di effettivitŕ del diritto comunitario: ovvero, il provvedimento cautelare a carattere inibitorio. L'A. auspica, in conclusione, un mutamento della giurisprudenza comunitaria in materia, anche alla luce degli orientamenti manifestati dalla Corte europea dei diritti dell'uomo.
