II est vrai que Talcott Parsons a tardé à reconnaître la place du droit dans la vie sociale et qu'il n'en a pas traité autant qu'on aurait pu l'attendre de sa part, compte tenu de l'influence exercée sur lui par Weber et Durkheim. On trouve pourtant, à différents endroits de son œuvre, des analyses du droit et de la profession juridique qui ont été négligées par la plupart des commentateurs de Parsons. Le droit et la profession juridique sont apparus importants à Parsons notamment comme éléments de réponse au problème de l'ordre social, comme facteurs à considérer dans le changement et l'évolution sociale, et comme dimensions fondamentales de la modernité. Ces analyses l'ont finalement amené à s'interroger sur les raisons pour lesquelles les sociologues contemporains en sont venus à ignorer le rôle et les fonctions sociales du droit. La sociologie du droit de Parsons révèle cependant une faiblesse dans la pensée de Parsons: l'État moderne n'a jamais fait l'objet d'une attention et d'une analyse quelque peu approfondies de la part de Parsons, ce qui n'a pu que nuire à sa sociologie juridique.
