La loi CMU, votée en 1999, proclame l’universalité de la couverture maladie. Or, elle réunit dans ses deux premiers volets le principe d’une universalité, avec l’introduction du critère subsidiaire de résidence (CMU de base), et une condition de ressources pour l’octroi d’une protection complémentaire en matière de santé (CMU complémentaire). Ces éléments existent déjà dans le système français de protection sociale, mais introduisent de nouvelles pratiques à prendre en considération par les organismes gestionnaires de l’assurance maladie de la Sécurité sociale, où la contributivité est historiquement la référence pour bénéficier de prestations. Pour saisir les points d’inflexion aussi bien que les rapports de force qui ont conduit à la création du dispositif CMU, nous chercherons à répondre à trois questions : pourquoi cette réforme ? Pourquoi ces modalités dans la construction du dispositif de la CMU complémentaire ? Entre continuités et changements, quelle est la place de la CMU de base et de la CMU complémentaire dans le système de l’assurance maladie et celui de l’assistance ? On peut aussi se demander dans quelle mesure la mise en oeuvre de la CMU se traduit par des réformes concrètes de l’accès aux soins et modifie les frontières entre assurance et assistance.
