« L’eau : un droit pour tous ou un bien pour certains » reflète une analyse contemporaine du cadre juridique de l’eau. Plus particulièrement, l’étude s’attarde à la dichotomie qui existe entre la liberté de commerce et les droits de la personne au sein de la société internationale. Primo , les auteurs examinent la conception marchande de l’eau. À ce sujet, ils explorent succinctement la vision de développement durable, le commerce dit équitable et viable, pour ensuite étudier l’idéologie néolibérale sous-tendant les traités de l’Organisation mondiale du commerce (OMC) et de l’ Accord de libre-échange nord-américain ( ALÉNA ). Ces derniers rendent le libre marché et les intérêts corporatifs prioritaires sur les droits des citoyens. Résultat : l’accès à l’eau devient un privilège des biens nantis. Secundo , les auteurs allèguent, en réponse à la marchandisation de l’eau, la conception humaniste de l’eau. Celle-ci est évoquée sous différents angles. Apte à être partagée pour et par tous, l’eau, vue comme un bien commun, neutralise la privatisation. De cette manière, tout être humain bénéficierait d’un réel accès à l’eau, ce qui serait corroboré par le droit à l’eau au plan international. Les auteurs se penchent également sur le cadre législatif international, afin de retracer un véritable droit à l’eau, que ce soit économiquement, socialement, culturellement ou autrement. Enfin, comme dernière analyse, ils présentent une approche des positions des gouvernements fédéral (Canada) et provincial (Québec). Ceux-ci se partageant tous deux le champ de compétence législatif de l’eau en vertu de l’ Acte de l’Amérique du Nord Britannique .
