Abstract
The principle of open justice is one of the most pervasive axioms of the administration of justice in common law systems. While it has a common law origin, and retains its force as such in many common law nations, it has been constitutionally enshrined in a substantial number of jurisdictions. Indeed, the significance of the principle is of such a high order that, even in the absence its recognition in a written constitution, the principle should be regarded as of constitutional significance. This paper adopts a comparative law perspective to discuss the scope of the principle and its application in a number of major jurisdictions, including Great Britain, Australia, the United States and Canada, the relevance of the principle to the free press, the approach taken by different jurisdictions to balancing conflicting rights with the principle, and the differing judicial attitudes to pre-trial publicity and restricting the jury’s access to publicly available material.
