Abstract
Une approche socio-légale du divorce constitue le support d'une analyse des déterminations institutionnelles (juridiques, judiciaires, politiques, administratives) s'appliquant à la sphère familiale et à ses membres comme sujets de droit. Le dévoilement ainsi opéré de processus d'ajustements, d'oppositions, de contradictions entre des logiques multiples - celle des sujets eux-mêmes, celles des agents et des institutions de "contrôle social" - participe d'une sociologie des régulations sociales conçue comme sociologie politique du droit. À l'inverse d'une certaine sociologie du droit, celle-ci rompt avec l'idée d'un positionnement rationnel et maîtrisé du droit face au changement social pour intégrer ce dernier dans un système agissant comme "structure complexe de causalités" mêlant pratiques et attentes sociales, stratégies et relations de pouvoir.
