Abstract
Het collectieve-actierecht van werknemers is uitdrukkelijk uitgesloten van de regelingsbevoegdheid van de EU (artikel 137, vijfde lid, EG). Waar de Europese regelgeving mogelijk met dat uitgangspunt in conflict zou kunnen komen bevat ze uitdrukkelijke waarschuwingen dat zulks niet de bedoeling is. De spanning tussen aan het Europese recht ten grondslag liggende liberale marktprincipes en de beschermende beginselen van het collectieve arbeidsrecht maakt echter op den duur een afbakening noodzakelijk. Een procedure voor het HvJ EG kon dus niet uitblijven, zoals Jacobs opmerkte in zijn vorig jaar in dit blad gepubliceerde artikel over de zaken Viking en Laval waarin het HvJ EG (hierna ook: het Hof) inmiddels uitspraak heeft gedaan. Ik bespreek hier beide arresten tezamen. De meeste aandacht besteed ik aan de Laval zaak omdat die arbeidsrechtelijk het interessantst is.
