Abstract
Korean anti-discrimination legislations including the Act on Equal Employment and Support for Work-Family Reconciliation (AEESWR), Act on Age Discrimination Prohibition in Employment and Aged Employment Promotion (AADPE), and Act on Employment Promotion and Vocational Rehabilitation for Disabled Persons (AEPVRDP) prohibit discrimination based on prohibited grounds. The legislations also regulate exceptions, such as bona fide occupational qualification. Conspicuously, Korean legislations also include a very unique term called “reasonable reason.” In practice, this term is applied in the case of exceptions. However, legislations and interpretations have not established the mutual relations and connections concerning bona fide occupational qualification and “reasonable reason.” This disconnect has been the cause of conflict and confusion when justifying the violations of the anti-discrimination laws. Most cases have understood this unique term as “social common notion” even though the legislations regulate the statutory exceptions. This study both identifies potential problems under the Korean system, and through an examination of the Canadian and U.S. legal systems, introduces a method of interpretation of justification on anti-discrimination legislation.
