Abstract
Cet article propose une problématisation du rôle que peuvent être amenées à jouer sur le plan de l’innovation cognitive les organisations de réflexion juridique situées à la marge des frontières communicationnelles du système de droit criminel. Prenant appui sur une étude de cas, celle du Comité canadien de la réforme pénale et correctionnelle (1969), nous observons dans cette organisation, un travail de réflexion critique sur les principes et objets fondamentaux du droit criminel moderne qui favorise l’émergence d’un système de pensée susceptible de concurrencer le système de pensée dominant. En cheminant vers le centre, nous faisons l’hypothèse que les idées innovatrices proposées par les organisations périphériques peuvent ainsi, sous certains conditions, contribuer à l’évolution identitaire du système de droit criminel moderne.
