Bien que la concession de permissions et de facultes represente une large part du travail des canonistes dans les chancelleries, le Code n'en etablit les regles qu'en reference aux rescrits. L'A. clarifie ici leur nature juridique et les normes qui les regissent. Il limite son etude au terme licentia tel qu'utilise dans le Code latin au c. 59, 2, c'est-a-dire «permission». Les «permissions», «autorisations» et «facultes» sont des notions juridiques semblables. Une faculte est «un pouvoir ecclesiastique ou une autorisation exigees pour l'execution legitime d'un acte ministeriel ou administratif accomplis au nom de l'Eglise». Conceder une faculte qui accorde un pouvoir est toujours un acte du pouvoir executif de gouvernement. Une autorisation, d'autre part, est la concession d'une faculte pour accomplir des actes n'impliquant pas le pouvoir de gouvernement. La concession de licentiae est un acte administratif particulier et, donc, aussi un acte du pouvoir executif. Selon l'usage qu'en fait le Code latin, l'A. divise les licentiae en trois categories: a) les autorisations pour des actes ministeriels accomplis au nom de l'Eglise; b) les autorisations pour des actes administratifs accomplis au nom de l'Eglise; ou c) les permissions pour des actes accomplis en son propre nom. D'apres cette analyse, la nature juridique de licentiae peut donc etre definie comme «une autorisation ou une permission habilitant une personne a accomplir legitimement un acte au nom de l'Eglise ou en son propre nom». La deuxieme partie de l'article concerne la concession de facultes et de licentiae : etant un acte administratif particulier, elle est regie par les normes des cc. 35-47. Les normes concernant les rescrits et les actes du pouvoir executif (cf. c. 59, 2) sont egalement applicables aux concessions de licentiae et de facultes habituelles.
