Abstract
A estipulação em favor de terceiros apresenta-se como uma figura de grande complexidade teórica. O Código Civil de 2002 manteve sem resolver uma série de questões de relevância como a problemática da aceitação do terceiro, a revogação do benefício e as relações entre os distintos participantes que, à luz do direito comparado, poderiam ter sido melhoradas. Com base nos códigos de Quebec, Louisiana, e no Projeto de Código Civil argentino de 1998, analisamos esta forma contratual com sugestões de possíveis alternativas para as diversas problemáticas apresentadas.
