Les changements qui se produisent dans le système de droit pénal occidental et la manière de les analyser sont au cœur de cette contribution. Notre article se veut en effet une réflexion sur l’innovation en tant qu’outil sociologique pour observer le changement pénal. Après avoir souligné les obstacles sociologiques que la sociologie critique rencontre pour identifier des changements (innovants) au sein du système de droit pénal (1), nous explorerons la problématisation théorique de l’innovation pénale ainsi que son point de départ, la rationalité pénale moderne (2). Plus concrètement, et à titre de mise à l’épreuve de notre opérationnalisation théorique, nous réfléchirons ensuite aux fenêtres d’opportunités qui se présentent pour une lecture innovante du changement pénal. À ce titre, nous nous focaliserons essentiellement sur l’une d’entre elles : les travaux communautaires. Derrière leur ambivalence, ceux-ci présentent en effet certaines « prédispositions» à l’innovation, surtout dans le casbelge (3). Deux éléments cruciaux en termes de potentiel innovateur seront ainsi décrits : la mutation statutaire d’une mesure en peine d’une part ; l’émergence d’un modèle pénal de l’aide qualifiable d’inattendu d’autre part(3.1.). Après avoir décrits et situés historiquement ces deux éléments, nous proposerons un examen plus pointu de la dimension innovatrice de la mutation statutaire (3.2.) et du modèle d’aide émergent (3.3.), l’objectif ici étant moins de prétendre à l’exhaustivité empirique que de susciter un intérêt pour les enjeux théoriques et conceptuels de nos propos.
