Abstract
Dans ce texte, l’auteur fait appel à Kafka pour analyser le premier rapport du juge Gomery sur l’affaire des commandites. Il conclut que le premier rapport Gomery est une faillite à deux niveaux. D’abord, parce que le juge a construit son rapport sur un grand nombre de présomptions discutables. Et ensuite, parce qu’il a évité de commenter la source profonde de cette affaire qui touche le cœur du fédéralisme canadien : jusqu’à quel point est-il légitime dans une démocratie pour « un parti au pouvoir » d’utiliser les fonds publics pour des opérations de marketing visant à convaincre la population que « son option » ou « sa cause » est la bonne ?
