L’article interroge le droit en prison à partir de l’expérience des proches de détenus. Au-delà des textes juridiques, on en sait encore peu sur la manière dont les droits relatifs à la vie familiale des détenus s’observent de manière concrète. Comment les proches de détenus et les surveillants s’approprient, usent et interprètent le droit ? En quoi leurs interactions impactent sur la mise en œuvre des règles juridiques ? À partir d’une enquête de terrain réalisée en France, l’article montre ce qui motive les décisions des surveillants dans l’application du droit. Il témoigne aussi des usages différenciés que les proches de détenus font de leurs droits qui sont rarement défendus dans le cadre d’une mobilisation collective.
