Abstract
Cet article porte un regard critique sur les incongruités et les incohérences de la défense de contrainte morale en droit pénal canadien. Les auteurs soulèvent les difficultés liées à la fragmentation de ce moyen de défense ainsi que leurs conséquences négatives sur le traitement égal des personnes accusées du même crime. Le constat qui s’en dégage est que la défense de contrainte morale devrait être uniformisée sur le territoire canadien et harmonisée avec le droit international afin de permettre à tous ceux qui violent la loi en raison de l’absence d’autre choix viable de se prévaloir de ce moyen de défense. Enfin, à la lumière de l’état actuel du droit relatif à la défense de contrainte à la suite de l’arrêt R c Ryan, rendu récemment par la Cour suprême du Canada, les auteurs suggèrent une disposition inclusive qui devrait remplacer l’actuel article 17 du Code criminel.
