Abstract
Cet article montre comment les différents moments de l’oeuvre de Simmel sont traversés par la nécessité d’une reformulation de la problématique libérale de l’obligation. Si la responsabilité des actions — comme cela est suggéré par l’invention des droits sociaux — n’est plus imputable aux seuls individus et si la rationalité de la loi n’est pas déterminable par le seul droit positif ou par les abstractions du droit naturel, ces aspects obligent à une révision sociologique du concept moderne de liberté. Hors du cadre naturaliste, positiviste et historiciste duxixesiècle, cette révision passe forcément par une analyse et une critique du lien étroit que les Modernes établissent entre universalisme et formalisme juridico-économique. En ce sens, la réflexion de Simmel représente une acceptation de la dimension historique de ce phénomène, mais veut pourtant la dépasser à travers une réflexion éthico-politique capable de laisser émerger un universalisme d’un genre nouveau, immanent au formalisme moderne.
