El trabajo analiza, a partir de una presentacion general del sistema sanitario publico canadiense, los efectos que sobre el mismo esta suponiendo en la actualidad el pronunciamiento de 2005 de la Corte Suprema en el caso Chaoulli c. Quebec , reconocida como la sentencia mas importante en materia de derechos sanitarios en Canada en la ultima decada. En la medida en que este pronunciamiento ilustra el avance del sector privado en el ambito de la salud, evidenciando que la prestacion privada de los servicios sanitarios esta llamada a incidir en la calidad de los mismos y en los derechos de los pacientes y usuarios, se propone como sustrato para el estudio comparado.
