Abstract
Exhaustive analysis of the Court of Justice's case-law, since 1954 and by key periods, on the notions of equality, discrimination, direct and indirect, and obstacle. State of play in 2005. In depth analysis of the case-law of the European court of Human Rights, the US Supreme Court, the Canada Supreme Court and the High Court/Federal Court of Australia on the notions of equality and discrimination. Useful lessons which can be drawn from the comparison in order to suggest possible solutions to remedy the current flaws of the Court of Justice's jurisprudence.
