Abstract
Pour démontrer que le concept légal d’intérêts diffus est un instrument pour la justice et la démocratie environnementale, il faut tout d’abord le comprendre dans le contexte des fonctions sociales du procès judiciaire. Au-delà des intérêts individuels et de l’intérêt public, il existe dans certains systèmes juridiques, et en particulier dans celui des pays lusophones, une consécration des intérêts trans-individuels, dont les intérêts diffus sont une sous-catégorie. Le système d’action populaire est l’aboutissement de l’objectif de concrétisation de la protection des intérêts diffus sur le plan de la procédure juridictionnelle. La conséquence est une protection plus effective des droits environnementaux, à travers une représentation plus élargie.
