Abstract
Cette étude envisage la possibilité de considérer l’environnement non pas comme un intérêt personnel ou général, mais comme un intérêt collectif. Cette notion peu usitée, voire occultée, est ainsi analysée en droit français et dans le domaine de l’environnement afin de caractériser l’intérêt collectif environnemental. L’analyse permet alors de révéler toute la spécificité, mais aussi la cohérence que pourrait recéler l’action en responsabilité civile en termes de recevabilité comme de bien fondé en cas d’atteinte à l’environnement. En effet, l’intérêt collectif environnemental facilite la distinction à opérer entre action de groupe (défendant l’addition d’intérêts individuels) et action en défense d’intérêts collectifs indivisibles (comme en matière environnementale). Il apporte aussi des précisions utiles sur le préjudice écologique encore bien flou (préjudice collectif) et les modalités de sa réparation en nature si possible.
