Abstract
Résumé En dépit de l’oubli presque complet dans lequel est tombée la philosophie du droit de Rudolf Stammler, l’auteur estime que sa critique par Max Weber conserve toute son importance pour la sociologie du droit. Trois éléments fondamentaux de la conception de Stammler sont ici mis en relief : la régul a rité lég ale de la vie sociale ; l’opposition entre causalité et télos ; enfin, l’idée du droit juste . Cette conception qui vit Stammler tenu en haute estime par des théoriciens du droit importants fut l’objet des foudres de Weber. En particulier, Weber critique Stammler pour utiliser le concept de « règle de droit » sans distinguer clairement entre les perspectives hétérogènes de la sociologie, de la dogmatique juridique et de la philosophie du droit. Pour l’auteur, la critique wébérienne de Stammler demeure dans l’ensemble pleinement justifiée. Il reste toutefois que, contrairement à Stammler, Max Weber n’a pas anticipé l’émergence d’une « jurisprudence des valeurs » caractéristique du droit constitutionnel contemporain.
