Abstract
L'acte juridique est un des elements les plus fondamentaux du systeme canonique; on le retrouve dans tous les aspects du droit canonique. Dans cet article, l'A. se penche sur les actes juridiques du Livre VII du Code de 1983. La nature de l'acte juridique est rappelee en premier, en particulier la distinction entre l'habilitas et la capacitas de la personne qui accomplit l'acte juridique. L'A. examine ensuite les actes juridiques impliquant l'exercice du pouvoir judiciaire, soulignant qu'il y a plusieurs actes juridiques non-judiciaires dans le Livre VII: ceux qui n'exigent pas l'exercice du pouvoir de gouvernement, ceux qui impliquent l'exercice du pouvoir legislatif et ceux qui impliquent l'exercice du pouvoir executif. En dernier, l'A. presente la theorie que le droit universel accorde l'habilete aux juges (habiles) d'accomplir des actes du pouvoir executif.
