Abstract
Au Canada, un certain nombre de groupes autochtones privés de statut officiel se sont tournés vers les tribunaux afin d’obtenir la reconnaissance de leur identité autochtone et des droits qui en découlent. Dans la plupart des cas, ces tentatives se sont soldées par un échec. La présente étude montre que le manque de ressources de ces groupes et leur incapacité à se conformer à l’image populaire stéréotypée du groupe autochtone constituent des facteurs importants qui expliquent le refus des tribunaux de donner suite à leurs revendications. Cela suggère que la visibilité ou l’invisibilité d’un groupe marginalisé est un facteur déterminant dans la réponse des tribunaux à ses besoins.
