Abstract
Résumé Le but de cet article est de cerner les raisons de l’échec des tentatives de juridicisation et de judiciarisation de la vie économique et sociale en Haïti. Plusieurs aspects sont abordés : les motivations premières des acteurs de ces entreprises, les représentations du droit légal à la base de leurs démarches, la vulnérabilité structurelle défavorable au maintien du système légal en Haïti. Cet article interroge les conditions d’efficacité et d’efficience de tout système juridique reposant sur le principe de légalité.
