Abstract
L’animal est protégé en droit pénal français notamment contre les mauvais traitements et les actes de cruauté. Pour rendre cette protection effective, le code de procédure pénale permet aux associations de protection animale de se constituer partie civile pour défendre les intérêts des animaux victimes de telles infractions. Cette représentation des individus d’une espèce animale devant le juge interroge quant à l’intérêt défendu : est-ce l’intérêt de l’animal qui est représenté lors de sa protection ou plutôt celui de son propriétaire ou même l’intérêt général ? Nous constaterons qu’il existe aujourd’hui une forme de représentation indirecte de l’intérêt de l’animal qui reste cependant relativement limitée. Pour que cette représentation devienne utile et effective, il faudrait cependant que l’intérêt de l’animal puisse être défendu directement devant les juridictions et qu’il lui soit dès lors accordé un statut juridique autre que celui d’objet de droit.
