Abstract
L’État n’a pas formellement de compétence exclusive pour défendre les intérêts environnementaux devant le juge, mais c’est lui qui a l’approche la plus globale de l’intérêt général que sous-tend leur protection : les personnes physiques sont limitées dans leur intérêt à agir par leur intérêt personnel et immédiat, comme le sont les associations contraintes par leurs statuts tandis que les collectivités territoriales sont enfermées par les frontières de leur territoire de compétence. La possible carence de l’État dans son action impose de s’interroger sur des solutions de substitution, parallèles, complémentaires ou supplétives, impliquant une compétence partagée de défense de l’environnement.
