Abstract
Les democraties occidentales disposent de moyens juridiques pour proteger leurs majeurs incapables. Selon les pays, cette protection sera axee soit sur le patrimoine (Quebec, Pays-Bas), soit sur la personne (Ecosse), plus rarement de maniere equilibree entre les deux (Allemagne). Plus les legislations sont recentes, plus le droit a la personne predomine. De meme, la culture du pays va favoriser soit une protection « etatique » comme au Quebec et en Allemagne, soit une protection plus communautaire : au niveau de la commune (Pays-Bas) ou au niveau de la communaute locale (Etats-Unis), meme si, dans ces pays, il existe des legislations d’Etat. On insiste, en comparaison avec la France, sur une plus grande souplesse des mesures, une non-definition a priori des incapacites juridiques et, surtout, un faible pourcentage des mesures et leur caractere temporaire.
