La logique des acteurs en contexte permet de comprendre comment les micro-événements qui s’y ancrent participent aux différentes tendances macrosociologiques. C’est dans cette perspective que la présente contribution explore la question de l’assomption par les juges de leur propre contribution dans la peine qu’ils octroient et ses conséquences. D’un côté, le juge tend à dénier sa responsabilité et de l’autre, il survalorise celle du justiciable. La confrontation des résultats de quatre recherches réparties dans le temps et dans deux systèmes juridiques vise à mettre en lumière les constantes et les tendances au changement dans cette attribution des responsabilités.
