Abstract
Le système pénal canadien réagissait très sévèrement dans les cas de femmes « maricides ». En effet, sous la loi anglaise, les femmes qui tuaient leur conjoint risquaient d’être accusées de « petite trahison » pouvant mener à la peine de mort. Entre 1351 et 1828, une femme accusée d’avoir tué son mari pouvait être inculpée de ce crime et non de meurtre prémédité et, jusqu’en 1790, conduisant à l’exécution publique sur le bûcher.
