Abstract
2009년 EU는 바다표범 제품의 판매와 관련하여 일정한 요건을 부과하였는데, 이뉴잇(inuit)족 또는 토착민이 생존을 위해 사냥한 바다표범으로 만든 제품(IC condition)이나 해양자원관리 차원에서 사냥한 바다표범으로 만든 제품(MRM condition)이 아닌 경우 EU 시장 내에서 판매를 금지하는 조치를 단행하였다. 이러한 EU의 바다표범 규제조치에 따라 캐나다와 노르웨이산 바다표범 제품의 판매 및 수입을 제한하는 결과를 가져오게 되었다. 이에 캐나다와 노르웨이는 동 조치가 GATT협정상 ‘비차별’규정(제I조 1항과 제III조 4항)과 TBT협정상 ‘비차별’규정(제2조 1항) 그리고 ‘불필요한 무역장애금지’규정(제2조 2항) 등에 위배된다고 주장하였다. WTO 패널은 TBT협정 위반 여부와 관련하여, EU가 캐나다산 바다표범 제품에 대한 “유해한 효과”가 “정당한 규제적 구분”으로부터 온전히 기인한다는 것을 증명해내지 못하였기에 EU의 바다표범 규제조치 상 “IC 예외” 규정과 “MRM 예외” 규정은 제2조 1항 ‘비차별의무’ 위반이라고 결정하였다. 그러나 EU의 바다표범 규제조치가 어느 정도 바다표범의 보호에 관한 “EU 공공의 도덕적 관심을 표명”하고 있으며, 규제 목적을 달성하기 위한 동등한 기여를 할 수 있는 대안이 존재하지 않으므로 제2조 2항 ‘불필요한 무역장애금지의무’를 위반하지 않았다고 결정하였다. GATT협정 위반 여부와 관련하여, EU의 바다표범 규제조치는 경쟁기회의 변경에 따른 “유해한 효과”를 야기하며, 캐나다와 노르웨이산 바다표범 제품에 대하여 동종의 그린란드산과 산 제품보다 EU ‘불리한 대우’를 부여하고 있으므로 제I조 1항 ‘최혜국대우의무’와 제III조 4항 ‘내국민대우의무’ 위반이라고 결정하였다. 그리고 EU가 바다표범 규제조치 상 “IC 예외”와 “MRM 예외” 규정의 차별적 효과가 제XX조 (a)에 따라 정당화된다는 것을 입증해내지 못하였다고 결정하였다. 본 연구는 이러한 TBT협정과 GATT협정상 ‘내국민대우의무’에 대한 패널의 입장과 양 협정간의 관계에 대하여 중점적으로 분석하고자 한다. 그리고 TBT협정 제2조 1항의 ‘불리한 대우’ 요건을 판단함에 있어 이전의 WTO DSB 결정과 다른 양상을 보이고 있는지와 제2조2항 ‘불필요한 무역장애금지의무’와의 관계에 대해서도 분석하고자 한다.
