L'Autore analizza il potenziale impatto che la sentenza puň avere sulla disciplina che regola il distacco transnazionale nell'ordinamento italiano (dettata dal d.lgs. 72/2000, che recepisce la direttiva 96/71/CE). Il confronto con la normativa svedese, riformata per adeguarsi ai della Corte, evidenzia come la differenza tra i due sistemi di implementazione della direttiva sia piů apparente che reale. Anche in Italia, infatti, spetta in ultima analisi all'azione sindacale ed all'esercizio dell'autonomia collettiva garantire l'applicazione del contratto collettivo alle imprese straniere. Ciň che caratterizza maggiormente il sistema italiano č piuttosto l'alto grado di ineffettivitŕ dei diritti dei lavoratori distaccati, dovuto sia alla debolezza dell'azione sindacale che (soprattutto) alle lacune del sistema ispettivo.
