Abstract
Résumé Cette note vise à rendre compte de la conception leibnizienne de la perfectibilité du droit. En complétant l’analyse de la fonction normative de la cité de Dieu opérée par Werner Schneiders dans un article canonique publié en 1977 dans les Studia Leibnitiana , nous tenterons de montrer comment cette perfectibilité du droit se ramène à la recherche d’une conformité du droit volontaire au droit naturel et à quelles conditions elle est réalisée. Nous donnerons ainsi une nouvelle justification, d’un point de vue juridico-politique, de la continuité entre le monde naturel et le monde moral que Leibniz n’aborde explicitement que d’un point de vue métaphysique.
