Le renouvellement du droit applicable aux telecommunications par satellite se pose avec une acuite particuliere, du fait du mouvement de liberalisation du marche. Ce processus implique des mutations reglementaires globales et un ajustement au niveau des legislations nationales. Il existe une dialectique entre la logique de globalisation, inherente au developpement de reseaux globaux de communication par satellite, par definition rebelles a toute notion de frontiere, et une visibilite nouvelle du role des Etats qui se reapproprient des spheres de puissances dans les espaces reglementaires liberes par la globalisation. Cependant, ce renouvellement du droit des telecommunications par satellite est a l'origine de la desuetude progressive du droit de l'Espace, pourtant a bien des egards utile a la reglementation en cours d'elaboration, ne serait-ce que par son aspect ethique et par son realisme avant-gardiste vis-a-vis des activites spatiales commerciales. La regulation moderne aurait pu s'en inspirer ou meme s'appuyer dessus. Force est de constater, a l'examen du traitement reserve a la gestion des ressources naturelles spatiales par les Etats, que le droit de l'Espace est un droit depasse, la concurrence des droits composants la sphere juridique spatiale lui ayant ete defavorable.
