Abstract
L’article met en évidence les caractéristiques du régime linguistique canadien en le comparant à celui de la Belgique. Au Canada prévaut une conception libérale des droits individuels, qui est refusée par le Québec, où les droits linguistiques ont plutôt une valeur communautaire. L’incapacité de la société canadienne à résoudre cette opposition dans le texte constitutionnel a produit chez les francophones un sentiment d’extranéité. Le modèle belge est au contraire plus consensuel. La législation linguistique en Belgique repose sur un compromis qui est garanti par la Constitution. La participation des deux communautés à la révision de la Loi fondamentale, et donc leur contribution à l’élaboration des articles sur l’emploi des langues, sont assurées par les majorités spéciales requises pour toute modification de la Constitution. Même si des différences importantes séparent la vision francophone et celle des Flamands, le principe de territorialité et celui d’homogénéité linguistique, qui sont à la base du régime linguistique belge, ont été acceptés par les deux groupes et inscrits dans la Constitution.
