Abstract
Résumé Les médiations s’essaient en Europe. Le concept essaime ; toutefois, il ne se circonscrit ni à ses sujets, ni à ses objets, ni à ses méthodes, ni à ses outils, ni à ses finalités. Le présent article définira le « cœur médiationnel » et le situera dans les préventions et règlements des différends (PRD). Les PRD sont encouragés par la réglementation européenne : le Conseil de l’Europe et l’Union européenne s’en préoccupent. Ils sont aussi stimulés par les lois nationales, comme par exemple aux Pays-Bas et en Italie. Toutefois, cette bienveillance légale n’est pas distillée sans exigence de contrepartie ni sans risque d’allégeance.
