Abstract
La sentencia de la Sala I del Tribunal Supremo objeto de comentario, destacada, en su dia, por algunos medios de comunicacion, sienta doctrina acerca de la restriccion del acceso al publico en general, de urbanizaciones o edificios privados, constituidos en regimen de propiedad horizontal, que tienen no solo viviendas, sino tambien locales comerciales, abiertos al publico (en el caso, un restaurante): la decision mayoritaria sobre el cierre, adoptada por la junta de copropietarios no es valida si de ello resulta, con abuso de derecho, un perjuicio al copropietario de tales locales. Esta doctrina debe valorarse, en cada caso, tomando muy en cuenta, las circunstancias facticas concurrentes.
