O Tratamento Judicial da Violência Conjugal no Canadá: resposta punitiva, marcadores sociais e expectativas das vítimas.

Abstract
- A presente pesquisa foi realizada durante o periodo de estagio de doutorado sanduiche, na University of Ottawa, no periodo de julho de 2012 a fevereiro de 2013, tendo como objetivo central a verificacao do funcionamento dos mecanismos judiciais de enfrentamento/tratamento da violencia contra a mulher no Canada. Para a coleta de dados, foi utilizada a analise de documentos oficiais do governo canadense, bem como pesquisa bibliografica. A pesquisa permitiu identificar o fluxo de processamento dos casos de violencia contra a mulher pelo sistema de justica canadense, com as diferentes possibilidades de encaminhamento do agressor. Com base nos dados levantados, e em analises desenvolvidas por pesquisadores canadenses sobre o tema, e possivel afirmar que, ainda que haja um grande investimento do governo canadense e a forte articulacao entre instituicoes de diversos âmbitos estatais, os indices referentes aos conflitos violentos conjugais nao apresentam uma queda significativa. Neste sentido, parece ser razoavel apontar a dificuldade do sistema penal em dar conta de conflitos desta natureza, uma vez que a leitura criminalizante apresenta uma serie de obstaculos para a sua compreensao e intervencao.
