Abstract
불확정적인 개념의 ‘서비스’가 무역의 대상이 되는 경우 어느 국가로부터 공급되는지, 즉 ‘원산지’가 어느 국가인지 여부 또한 간단하게 판단하기 어려운 경우가 많다. 그러나 WTO 체제에서 직접적으로 서비스를 다루고 있는 GATS에서의 원산지 규정은 명확하게 적용될 수 없는 경우도 많으며, 이와 관련한 판례 및 학술 연구 또한 매우 부족한 실정이다. 따라서 본 연구는 향후 관련 연구를 촉구하기 위하여 GATS에서의 서비스 원산지 규정과 관련 WTO 분쟁 사례들을 정리하여 기존 규정의 명확한 이해를 돕고자 하였으며, 특히 상업적 주재를 통한 서비스 공급을 중심으로 살펴보았다. 일반적인 서비스 원산지 규정을 두고 있는 GATS 제XXVIII조는 서비스의 공급형태에 따라 서비스의 국적을 구분하고 있다. 특히 상업적 주재의 경우 조문을 명확히 적용하기 어려운 경우가 많다. 동 조문에서 ‘법인’의 범위가 지점이나 대표사무소를 포함할 정도로 넓게 규정되어 있고, ‘다른 회원국의 법인’은 상업적 주재에 의해 서비스를 공급하는 경우 동 다른 회원국의 자연인 또는 법인에 의해 소유되거나 통제되는 법인을 지칭하는 것이지만 이를 판별할 구체적인 기준이 부족한 상황이다. 현재까지 WTO에서는 EC-Banana III, Canada-Autos, 그리고 China-Publications 에서 이와 관련된 패널 및 상소기관의 결정이 내려진 바 있으나 규정의 모호성을 완전히 보완하지는 못하였다. 서비스 원산지 규정은 WTO 도하라운드에서 이루어지고 있는 GATS 협정 발전관련 논의뿐 아니라 급격히 증가하고 있는 경제통합협정에 관련해서도 명확한 해결책을 제시하지 못하고 있는 실정이다. 먼저 서비스 원산지 특별규정인 GATS 제XXVIII조와 관련된 회원국의 지위 문제 및 개발도상국으로서의 혜택 부여 가능성 판단뿐 아니라, 내국민대우 및 최혜국대우 등 비차별의무 적용을 위해서도 서비스 원산지 규정이 좀 더 분명해져야 한다. 또한 새로이 도입코자하는 서비스 무역구제에서 ‘국내산업’ 정의와 관련해서도 원산지 결정 방식에 대한 합의가 필요하다. 나아가 오늘날 다수 급격히 증가하고 있는 경제통합협정과 GATS 제V조와의 합치성에 대해서도 여전히 모호한 점이 많다. 앞으로 이러한 논의의 중요성 강조와 문제제기가 효과적으로 이루어져야 하며, 기존 WTO 체제의 틀 안에서 뿐만 아니라 다양한 시각에서의 해결책이 국가적 차원에서 논의될 수 있기를 바란다.
