Abstract
À la suite d’une enquête de terrain réalisée dans un village de Transylvanie, cet article explore la mutation des pratiques successorales et des principes qui gouvernent la transmission du patrimoine dans le contexte de la transition postcommuniste. Il vise à identifier les mécanismes sociaux générés par la reprivatisation des propriétés foncières. Pour ce faire, les changements postcommunistes sont analysés dans une perspective historique qui distingue trois périodes allant de 1940 jusqu’à 2005 (l’avant, le pendant et l’après collectivisation). Le travail fait voir que la rétrocession des terres aux anciens propriétaires s’est produite à travers la transmission des propriétés foncières. Ce double processus amène une recomposition des stratégies successorales qui ravive l’opposition entre la norme juridique et les pratiques coutumières. Le conflit entre ces deux types de légitimité est un facteur qui a considérablement ralenti le processus de décollectivisation en Roumanie. Après avoir examiné l’évolution des mécanismes de la reproduction sociale en Roumanie, l’article met en lumière les impacts sociaux de la transition post-communiste et les nombreuses contradictions qu’elle engendre.
