Esta contribucion examina la doctrina reciente del Tribunal de Justicia y del Tribunal General de la UE en materia de legitimacion del particular en el control de la legalidad, especialmente en lo que respecta a los actos reglamentarios que no impliquen medidas de ejecucion. En el muy esperado asunto Inuit, el TJUE definio el concepto de reglamentario del art. 263 (4) TFUE como un acto de alcance general que no sea un acto legislativo. Al mismo tiempo, se baso en el nuevo art. 19(2) TUE para afianzar que el sistema de recursos jurisdiccionales de la Union es ahora completo. A pesar de esta hipotetica completud y de los cambios introducidos por el Tratado de Lisboa, el test sigue siendo dificil de cumplir para el ciudadano y podrian seguir existiendo situaciones de ausencia de recurso. Con el fin de evitarlas y teniendo en cuenta la futura adhesion de la UE al CEDH son necesarios esfuerzos concertados. De un lado, el Tribunal de Justicia debe resolver el problema de la carga de trabajo sin dejar que influyan en su propia jurisprudencia. Ademas, debe realizar una aplicacion estricta de los requisitos de la teoria del acto claro, que el tiempo parece haber banalizado. Tambien seria necesaria una recepcion benevola de las cuestiones prejudiciales y una profundizacion en el principio de responsabilidad del Estado por infraccion del Derecho de la Union cuando aquella tiene su origen en los tribunales nacionales. De otra parte, la Comision debe supervisar la peculiar aplicacion que algunos tribunales nacionales hacen de la teoria del acto claro. Por ultimo, aunque no menos importante, el articulo 19(2) TUE impone a los Estados miembros comprobar si sus ordenamientos preven recursos jurisdiccionales suficientes e incluso reflexionar una posible reforma procesal para establecer acciones declarativas que permitan al ciudadano controlar la legalidad de los actos legislativos de la UE, incluso si ninguna medida de ejecucion o incorporacion ha sido aun adoptada.
