Abstract
Dans cette affaire, le Conseil canadien des relations du travail (le Conseil), traite d'une plainte déposée par une employée qui prétend que son syndicat a manqué à son devoir de représentation juste en omettant de se conformer à une simple procédure administrative, cette dernière omission ayant pour effet de priver la plaignante de l'audition de son grief. Le contexte dans lequel cette décision a été rendue a ceci de particulier que le syndicat plaide coupable à l'accusation portée contre lui et qu'il offre de participer au redressement qui sera accordé par le Conseil. Malgré tout, le Conseil applique les critères généralement reconnus par la jurisprudence qui établissent une nette distinction entre une négligence «grave» et une négligence «simple», cette dernière étant insuffisante pour emporter l'application de l'article 37 du Code canadien du travail (le Code).
