Abstract
L'ampleur et la gravité des maladies dues à l'amiante sont à la base de la création en Belgique, au 1er avril 2007, de l'Asbest Fonds Amiante (AFA). Ce fonds indemnise les victimes, non professionnelles comme professionnelles. Une nouvelle association, l'ABEVA, a réussi à mettre à l'agenda politique l'idée d'une réparation pour toutes les victimes de l'amiante. Les interlocuteurs sociaux se sont montrés ouverts à l'idée d'une nouvelle réparation, mais réticents à la voir sortir de leur champ traditionnel. Les négociations touchaient à plusieurs problématiques sensibles: les maladies de l'amiante en dehors des entreprises, la contamination environnementale, la mise en cause de l'immunité des employeurs, l'indemnisation des indépendants, le financement, etc. Accepter le principe d'un Fonds amiante spécifique, c'est accepter une différenciation fondée sur l'histoire particulière de l'exploitation de l'amiante. Aux yeux des victimes, la gravité des atteintes à la santé et les négligences ou les mensonges qui jalonnent cette histoire justifient une réparation spécifique. L'AFA est une amélioration incontestable pour toutes les victimes de l'amiante, même s'il ne répond pas à la revendication de départ d'une réparation intégrale du dommage.
