À la suite de la réforme du droit de la famille de 1980, l’auteure démontre comment les concepts de sang, de nature et de vérité biologique ont acquis une importance croissante au sein du droit civil de la filiation au Québec, tant en matière de contestation qu’en réclamation de la filiation. En effet, alors qu’en vertu du Code civil du Bas Canada, l’élément biologique ne possédait pas de valeur en soi, celle-ci dépendant de sa reprise par le Juridique, l’article met en relief la manière dont une partie du droit de la filiation s’est peu à peu soumis à la vérité brute de la chair et des gènes. Ainsi, au-delà d’une analyse du discours législatif, jurisprudentiel et doctrinal, c’est la fonction normative du droit face à la réalité des faits que l’auteure interroge.
