En 1985, le législateur québécois se montrait avant-gardiste en conférant au travailleur victime d’une lésion professionnelle un droit de retour au travail chez son employeur. La même année, la Cour suprême du Canada déclarait que le droit à l’égalité impose à l’employeur une obligation d’accommodement ; or, ce concept a évolué de façon telle que les employés handicapés se sont vu reconnaître des droits relatifs au maintien en emploi qui dépassent dorénavant ceux qui étaient prévus dans le régime de réparation des lésions professionnelles. Jusqu’à présent, la Commission de la santé et de la sécurité du travail (CSST) et la Commission des lésions professionnelles (CLP) sont demeurées hermétiques à l’intégration de cette norme, car elles jugent que le régime de réparation des lésions professionnelles constitue un ensemble normatif autonome, qui comporte son propre processus d’accommodement légal. L’auteure soutient que cette interprétation ne respecte pas le caractère prééminent du droit à l’égalité ni la jurisprudence de la Cour suprême qui reconnaît aux tribunaux administratifs le pouvoir et le devoir d’en assurer le respect.
