Abstract
En octobre 2009, la ministre de la Justice du Québec, Kathleen Weil, déposait un avant-projet de loi touchant la filiation et l’autorité parentale intitulé Loi modifiant le Code civil et d’autres dispositions législatives en matière d’adoption et d’autorité parentale. Presque en même temps, en décembre 2009, la Commission de la science de l’éthique et de la technologie, placée sous la présidence d’Édith Deleury, déposait de son côté un rapport intitulé Avis Éthique et procréation assistée : des orientations pour le don de gamètes et d’embryons, la gestation pour autrui et le diagnostic préimplantatoire. Cet article s’attache à dégager ce que ces textes disent de la pluriparentalité et de la pluriparenté et des nouveaux rapports qu’ils permettent d’entrevoir entre le droit, l’individu et la famille.
